MyVideoVisa Privacy Notice
Uses
§
If you submit
personal information to MyVideoVisa, we may use that information to operate,
maintain, and improve the features and functionality of MyVideoVisa, and to
process any flagging activity or other communication you send to us.
§
We do not use your
email address or other personal information to send commercial or marketing
messages without your consent.
Publicly Available Information
§
When you create a
MyVideoVisa Account, some information about your MyVideoVisa Account and your
account activity will be provided to other users of MyVideoVisa. This may
include the date you opened your MyVideoVisa Account, the date you last logged
into your MyVideoVisa Account, your age (if you choose to make it public), the
country and the number of videos you have watched.

Your MyVideoVisa
Account name is displayed to other users when you engage in certain activities
on MyVideoVisa, such as when you upload videos or send messages through
MyVideoVisa. Other users can contact you by leaving a message or comment on the
site.
§
Any videos that you
submit to MyVideoVisa may be redistributed through the internet and other media
channels, and may be viewed by other MyVideoVisa users or the general public.
§
You may also choose
to add personal information which may include your name, gender, profile picture
or other details, that will be visible to other users on your MyVideoVisa
Account channel page. If you choose to add certain features to your MyVideoVisa
Account channel page, then these features and your activity associated with
these features will be displayed to other users and may be aggregated and shared
with your friends or other users. Such shared activity may include your favorite
videos, videos you rated and videos that you have uploaded.
Intellectual Property
You acknowledge that
the MyVideoVisa Site and Services contain information, software, photos, video,
text, graphics, music, sounds or other material (collectively, "Content") that
are protected by copyrights, patents, trademarks, trade secrets or other
proprietary rights, and that these rights are valid and protected in all forms,
media and technologies existing now or hereafter developed. All MyVideoVisa-generated
Content and Content provided to MyVideoVisa by its partners and licensors is
copyrighted individually and/or as a collective work under the U.S. copyright
laws; further, MyVideoVisa owns a copyright in the selection, coordination,
arrangement and enhancement of all Content and in the MyVideoVisa Site as a
whole. Solely for so long as you are permitted by us to access and use the
Services, you may download one copy of the materials on any single computer for
your personal, non-commercial home use only, provided you keep intact all
copyright and other proprietary notices, and are in compliance with these Terms
of Service. Unless otherwise specified, modification of the Content or use of
the Content for any other purpose, including use of any such Content on any
other Web site or networked computer environment is strictly prohibited. In the
event you download software provided by the MyVideoVisa Site, the software,
including any files, images incorporated in or generated by the software, and
data accompanying the software (collectively, the "Software") are licensed to
you by us. We do not transfer title to the Software to you. Except as otherwise
expressly authorized in writing in advance by us, you agree not to reproduce,
redistribute, sell, modify, rent, lease, loan, adapt, translate, create
derivative works based (whether in whole or in part) on, decompile, reverse
engineer, disassemble, or otherwise reduce all or any part of the Services,
including the MyVideoVisa Site, the Content or the Software.
The MyVideoVisa name
and logo(s) are the exclusive property of MyVideoVisa, LLC. or its affiliates.
All other trademarks appearing on the Services are trademarks of their
respective owners. Our partners or service providers may also have additional
proprietary rights in the content which they make available through the
Services. The trade names, trademarks and service marks owned by us, whether
registered or unregistered, may not be used in connection with any product or
service that is not ours, in any manner that is likely to cause confusion.
Nothing contained on the Services should be construed as granting, by
implication, estoppel or otherwise, any license or right to use any of our trade
names, trademarks or service marks without our express prior written consent.
Third Party Intellectual Property; Copyright Notifications
MyVideoVisa respects
the intellectual property of others, and we ask our users to do the same.
MyVideoVisa may, in appropriate circumstances and at its discretion, terminate
the accounts of users who infringe the intellectual property rights of others.
MyVideoVisa will remove infringing materials in accordance with the Digital
Millennium Copyright Act if properly notified that content infringes copyright.
If you believe that
your work has been copied in a way that constitutes copyright infringement,
please provide MyVideoVisa with a written notification containing at least the
following information (please confirm these requirements with your legal
counsel, or see Section 512(c)(3) of the U.S. Copyright Act, 17 U.S.C.
§512(c)(3), for more information):

an electronic or physical
signature of the person authorized to act on behalf of the owner of the
copyright interest;
-
a description of the copyrighted
work that you claim has been infringed;

a description of where the
material that you claim is infringing is located on the MyVideoVisa Site,
sufficient for MyVideoVisa to locate the material;
-
your address, telephone number,
and email address;
-
a statement by you that you have
a good faith belief that the disputed use is not authorized by the copyright
owner, its agent, or the law; and
-
a statement by you that the above
information in your notice is accurate and, under penalty of perjury, that
you are the copyright owner or authorized to act on the copyright owner's
behalf.
If you believe that
your work has been removed or disabled by mistake or misidentification, please
provide MyVideoVisa with a written counter-notification containing at least the
following information (please confirm these requirements with your legal counsel
or see Section 512(g)(3) of the U.S. Copyright Act, 17 U.S.C. §512(g)(3), for
more information):

a physical or electronic
signature of the subscriber/user of the Services;
-
identification of the material
that has been removed or to which access has been disabled and the location
at which the material appeared before it was removed or access to it was
disabled;

a statement made under penalty of
perjury that the subscriber has a good faith belief that the material was
removed or disabled as a result of mistake or misidentification of the
material to be removed or disabled; and
-
the subscriber's name, address,
telephone number, and a statement that the subscriber consents to the
jurisdiction of the Federal District Court for the judicial district in
which the address is located, or if the subscriber's address is outside of
the United States, for any judicial district in which the service provider
may be found, and that the subscriber will accept service of process from
the person who provided notification under subsection (c)(1)(C) or an agent
of such person.
You acknowledge that
if you fail to comply with all of the aforementioned notice requirements, your
notification or counter-notification may not be valid and that MyVideoVisa may
ignore such incomplete or inaccurate notices without liability of any kind.
Under Section 512(f)
of the Copyright Act, 17 U.S.C. §512(f), any person who knowingly materially
misrepresents that material or activity is infringing or was removed or disabled
by mistake or misidentification may be subject to liability.
